These Terms of Service (the "Terms") form a binding contract between you and Multi Layer Security Pvt. Ltd. ("MSecurity", "we", "us", or "our") covering your use of our security software for Windows, macOS, iOS and Android (the "Apps"), the website at msecurity.app (the "Site"), and any subscriptions you buy from us (together, the "Service"). By installing the App, creating an account, or paying for a subscription, you agree to these Terms. If you don't agree, don't use the Service.

For privacy questions, see our Privacy Policy, which is incorporated into these Terms by reference.

1. Who we are and who can use the Service

The Service is operated by Multi Layer Security Pvt. Ltd., a company registered in Nepal with its principal office at Koteshwor, Kathmandu, Nepal.

You may use the Service only if you can form a binding contract with us under the laws that apply to you, and only in compliance with these Terms and all applicable laws. If you are under 18 (or the age of majority in your jurisdiction), you must have a parent or legal guardian agree to these Terms on your behalf. We do not knowingly let children under 13 (or 16 in the EEA) create accounts.

2. Your account

To buy and manage subscriptions you need an MSecurity account. You agree to:

  • Provide accurate, current information (email, phone number for OTP verification) and keep it up to date;
  • Keep your password and OTP-receiving phone secure;
  • Be responsible for all activity on your account, including any device activated against your license keys;
  • Notify us at contact@msecurity.app as soon as you suspect unauthorised access.

One person, one account. You may not transfer your account, sell access, or let anyone else use your credentials.

3. The subscription

3.1 What you're buying

An MSecurity subscription is a licence to use the App on the number of devices and for the period you selected at checkout (e.g. "Antivirus — 3 devices — 1 year"). You don't own the App; we grant you a limited, non-exclusive, non-transferable right to install and use it for personal, non-commercial purposes during the subscription term. Business and enterprise use requires a separate agreement — please contact us.

3.2 Device limits and license keys

Each subscription comes with a fixed number of device slots. Activating MSecurity on a new device consumes a slot; deactivating a device (from the dashboard or by uninstalling and confirming) frees the slot. Attempting to bypass these limits (e.g. sharing a key publicly, key-cracking tools, virtual machines designed to spoof identity) may result in the licence being revoked without refund.

3.3 Free features and trials

Some features may be available for free or as a time-limited trial. We may add, remove, or change which features are free at any time. Trials automatically convert to a paid subscription only if you explicitly elected to enable that at signup; otherwise they simply end.

4. Payment, renewal, and cancellation

4.1 How you pay

Depending on where you are and how you bought the subscription, payment may be processed by:

  • Stripe — for card payments worldwide;
  • eSewa or Khalti — for NPR payments in Nepal;
  • Apple In-App Purchase — for purchases made inside the iOS or macOS App Store version of the App. The App Store terms govern your payment, refund rights, and renewal — those terms supersede sections 4.2–4.4 below for App Store purchases.
  • Google Play Billing — for purchases made inside the Google Play version of the App. The Google Play terms govern your payment, refund rights, and renewal — those terms supersede sections 4.2–4.4 below for Google Play purchases.

All prices are shown in your local currency when available; otherwise in US dollars. Prices include applicable taxes where we're required to collect them.

4.2 Auto-renewal

Subscriptions purchased directly from us (via Stripe / eSewa / Khalti) do not auto-renew by default. We will email you before your subscription expires and you can renew manually from your dashboard.

If you specifically enable auto-renewal at checkout, we will charge your saved payment method on or around the renewal date for the same plan and duration at the then-current price. We will email you a reminder at least 7 days before any auto-renewal charge. You can turn off auto-renewal at any time from Dashboard → Subscriptions.

4.3 Cancellation and refunds

You may cancel a subscription at any time. Cancellation stops future renewals; the current paid period continues to its natural expiry.

We offer a 14-day money-back guarantee on new subscriptions purchased directly from us. Email contact@msecurity.app within 14 days of the original purchase and we will refund the full amount to the original payment method. After 14 days, payments are non-refundable except where required by law.

For purchases made via Apple or Google, refund requests are handled by Apple or Google according to their policies — we cannot process those refunds directly. Use the refund flow inside the App Store or Google Play.

4.4 Price changes

We may change subscription prices for future renewals. If a price change affects your auto-renewing subscription, we will notify you by email at least 30 days before the change takes effect. You can decline by cancelling the auto-renewal before the next billing date.

5. Acceptable use

You agree not to, and not to permit anyone else to:

  • Use the Service for any unlawful, harmful, or fraudulent activity;
  • Reverse-engineer, decompile, or disassemble the App, except to the extent that applicable law expressly permits despite this limitation (e.g. for interoperability under EU law);
  • Resell, sublicense, rent, lease, or commercially exploit the Service or any part of it;
  • Use the VPN to send spam, conduct port scans, run brute-force attacks, distribute malware, distribute copyrighted material you don't have the right to distribute, or commit any activity that would be illegal in your jurisdiction or in the jurisdiction where the VPN server is located;
  • Disable, bypass, or circumvent the App's license enforcement, device limit, or update mechanism;
  • Use automated means (scrapers, bots, scripts) against the Service except for legitimate App functionality;
  • Use the Service to disrupt or attack any third party's systems, including our own.

We may suspend or terminate access without refund if we believe in good faith that you've violated this section. Where the violation is something you can fix, we'll usually ask you to fix it first; for serious violations (illegal activity, abuse of our infrastructure) we may act immediately.

6. The App and its updates

The App connects to our servers to validate your licence, fetch threat-definition updates, and (if you've enabled it) upload suspicious files for analysis — see our Privacy Policy for details. We may update the App at any time to fix bugs, improve detection, patch security issues, or comply with new platform requirements. Updates may be mandatory; if you decline a mandatory security update, parts of the Service may stop working.

We will give reasonable notice before discontinuing the Service or a major feature, except where a security or legal emergency requires faster action.

7. Third-party services

The Service relies on third parties (payment processors, app stores, SMS providers, our cloud host) and may link to or interoperate with third-party software (e.g. your operating system, browser plugins). We are not responsible for the privacy practices or content of any third party, and your use of any third-party service is governed by its own terms.

8. Intellectual property

MSecurity, the MSecurity logo, the Site, the Apps, and all related code, designs, and content are owned by Multi Layer Security Pvt. Ltd. or our licensors and are protected by copyright, trademark, and other laws. We grant you the limited licence described in section 3.1; we do not transfer any other rights. You may not use our trademarks without our prior written permission, except for descriptive references (e.g. "I use MSecurity").

If you submit feedback, suggestions, or bug reports, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use that feedback to improve the Service without compensation or attribution.

9. Disclaimers

MSecurity reduces — but does not eliminate — the risk of security incidents. No antivirus, VPN, or security product can guarantee 100% protection against all threats. You remain responsible for your own security practices, including keeping your operating system updated, using strong unique passwords, and not running untrusted software.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise — including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the Service will be free of bugs, errors, viruses (other than those we're designed to detect), or interruptions.

Some jurisdictions don't allow the exclusion of certain warranties — in those places, the exclusions above apply only to the extent permitted by law, and nothing in these Terms limits any warranty or right you have that cannot lawfully be limited.

10. Limitation of liability

To the maximum extent permitted by applicable law:

  • Neither party will be liable to the other for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, goodwill, or business — arising out of or related to these Terms or the Service, even if advised of the possibility.
  • Our total aggregate liability arising out of or related to these Terms or the Service, for any cause of action, is limited to the greater of (a) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.

These limits do not apply to (i) liability that cannot be excluded under applicable law (e.g. fraud, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer-protection rights); or (ii) our indemnification obligations expressly stated below.

11. Indemnification

You agree to defend, indemnify, and hold harmless MSecurity, its affiliates, and its and their officers, directors, employees, and agents from and against any third-party claims, damages, losses, and expenses (including reasonable lawyers' fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right through your use of the Service. We may, at our option, take over the defence of any such claim, in which case you will cooperate with us at our expense.

12. Termination

You may terminate these Terms at any time by closing your account from Dashboard → Settings or by emailing us. Termination does not entitle you to a refund except as stated in section 4.3.

We may suspend or terminate your access to the Service if:

  • You breach these Terms;
  • We are required to do so by law or by a competent authority;
  • Continued operation poses a security or legal risk to us, our other users, or third parties;
  • We discontinue the Service or a feature you depend on (in which case we will give reasonable advance notice and a pro-rata refund of any prepaid amount for the unused period).

On termination, your right to use the Service stops immediately. Provisions that by their nature should survive — including sections on intellectual property, disclaimers, liability limits, indemnification, governing law, and dispute resolution — will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (to the address on your account) at least 30 days before they take effect, and we will update the "Effective" date on this page. Non-material changes (typo fixes, clarifications that don't affect your rights) take effect on publication.

If you don't agree with a change, you may cancel your subscription before it takes effect and receive a pro-rata refund of any prepaid amount for the unused period. Continuing to use the Service after a change takes effect means you accept the updated Terms.

14. Governing law and disputes

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of Nepal, without regard to its conflict-of-laws principles. The courts of Kathmandu, Nepal have exclusive jurisdiction over any dispute, subject to your right to bring an action in your local courts where applicable consumer-protection law gives you that right.

Before filing a claim, you agree to first contact us at contact@msecurity.app and try in good faith to resolve the dispute informally for at least 30 days.

15. Region-specific rights

15.1 European Economic Area, UK, and Switzerland

If you are a consumer in the EEA, UK, or Switzerland, the following also apply:

  • You have a 14-day right of withdrawal from the date of purchase, during which you may cancel the contract for any reason and receive a full refund. This right may be lost if you start downloading or actively using the App during that period and you expressly agreed to that when buying — at checkout we ask whether you want to start using the App immediately.
  • Nothing in these Terms limits any non-waivable consumer right you have under EU/EEA/UK law, including statutory remedies for defective digital content.
  • You may bring proceedings in the courts of your country of residence; we may bring proceedings only in the courts of your country of residence.

15.2 California, USA

California subscribers may cancel and receive a refund of the unused portion of the subscription within 30 days of purchase under California Business and Professions Code §17602. Contact contact@msecurity.app to exercise this right.

16. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service, and replace any prior agreement on the same subject.
  • No waiver. If we don't enforce a right, that doesn't mean we waive it.
  • Severability. If a court finds any part of these Terms unenforceable, the rest stays in effect.
  • Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in a merger, acquisition, or sale of substantially all our assets, with notice to you.
  • Notices. We send notices to the email on your account. You send notices to contact@msecurity.app.
  • Force majeure. Neither party is liable for failure to perform due to causes beyond reasonable control (natural disasters, infrastructure outages, government action, war).
  • Language. These Terms are provided in English. Translations are for convenience only; in case of conflict, the English version controls.
